En este trabajo se analizan las cláusulas de liquidez constitucional (CLC), tal como han sido caracterizadas por José María Sauca. Sobre los rasgos estructurales, se sostiene, primero, que es difícil reconducir los ejemplos de CLC a un solo modelo, por cuanto, una vez introducida la distinción entre reglas prescriptivas y constitutivas, caben seis posibles reconstrucciones; segundo, que el principio de prevalencia, lejos de suponer que no hay contradicciones entre las normas que puedan emanar de las CLC y la normativa (...) constitucional, las presuponen; tercero, que mantener que las CLC implican una transferencia de soberanía solo puede obedecer a un uso ambiguo del término “soberanía”. Por lo que hace a las funciones, y en contra de lo sostenido por Sauca, se muestra que las CLC pueden conducir a mutaciones constitucionales y es factible considerarlas mecanismos de última palabra. The purpose of this qualitative study was to examine the perceptions related to ethics and cheating among a representative sample of primarily female undergraduate students, compared to trends reported in the literature. Focus groups were organized to discuss nine scripted questions. Transcripts and audiotapes were analyzed and four main themes emerged: demographics of those who cheat, students’ perceptions of cheating, the role of technology in cheating, and consequences of cheating, including students’ attitudes and behaviors related to reporting cheating incidents. Bandura’s (...) Social Cognitive Theory served as the theoretical framework to understand students’ varying perceptions of and justification for cheating, as well as the dynamics of honor code violations, via group discussion. Viewpoints on cheating were regularly discussed and contradictory views were identified related to frequency and justification for cheating. Utilizing the constant comparative method, students mentioned time limitations, and pressure from peers, parents, and professors as reasons to cheat. They also discussed pressures to achieve high grades for acceptance into graduate programs. Students were also reluctant to report their classmates for cheating incidents. Repeated and comprehensive education on ethical behavior is warranted. (shrink)

For the scholastic philosopher William Ockham (c. 1285-1347), there are three kinds of heresy. The first, and most unmistakable, is an outright denial of the truths of faith. Another is so obvious that a very simple person, even if illiterate, can see how it contradicts Divine Scripture. The third kind of heresy is less clear cut. It is perceptible only after long deliberation and only to individuals who are learned, and well versed in Scripture. It is this third variety of (...) heresy that J.M.M.H. Thijssen addresses in Censure and Heresy at the University of Paris, 1200-1400. The book documents 30 cases in which university trained scholars were condemned for disseminating allegedly erroneous opinions in their teaching or writing, and focuses particularly on four academic censures that have occupied prominent positions in the historiography of medieval philosophy. Thijssen grants central importance to a number of questions so far neglected by historians regarding judicial procedures, the authorities supervising the orthodoxy of teaching, and the effects of condemnations on the careers of the accused. He also places still current questions regarding academic freedom and the nature of doctrinal authority into their medieval contexts. (shrink)

Despite many attempts to achieve an adequate definition of living systems by means of a set of necessary and sufficient conditions, the opinion that such an enterprise is inexorably destined to fail is increasingly gaining support. However, we believe options do not just come down to either having faith in a future success or endorsing skepticism. In this paper, we aim to redirect the discussion of the problem by shifting the focus of attention from strict definitions towards a philosophical framework (...) that allows conceiving of living systems as a natural kind, but whereby natural kinds are not to be defined by fixed necessary and sufficient conditions. We argue for a property-cluster kind approach according to which living systems constitute a natural kind with vague boundaries, capable of changing, and whose members do not need to instantiate every property. We draw from Boyd’s homeostatic property-cluster theory and introduce two modifications, one regarding homeostatic mechanisms and another related to the scientific role of kinds. Thus, our view overcomes some difficulties of Boyd’s theory and we are able to account for the natural kindhood of living things. We also emphasize the most appealing features of our approach for specific research fields and address three objections to this sort of approach. (shrink)

Data involving epistemic modals suggest that some classically valid argument forms, such as _reductio_, are invalid in natural language reasoning as they lead to modal collapses. We adduce further data showing that the classical argument forms governing the existential quantifier are similarly defective, as they lead to a _de re–de dicto_ collapse. We observe a similar problem for disjunction. But if the classical argument forms for negation, disjunction and existential quantification are invalid, what are the correct forms that govern the (...) use of these items? Our diagnosis is that epistemic modals interfere with hypothetical reasoning. We present a modal first-order logic and model theory that characterizes hypothetical reasoning with epistemic modals in a principled manner. One upshot is a sound and complete natural deduction system for reasoning with epistemic modals in first-order logic. (shrink)

Three experiments examined contributions of study phase awareness of word identity to subsequent word-identification priming by manipulating visual attention to words at study. In Experiment 1, word-identification priming was reduced for ignored relative to attended words, even though ignored words were identified sufficiently to produce negative priming in the study phase. Word-identification priming was also reduced after color naming relative to emotional valence rating (Experiment 2) or word reading (Experiment 3), even though an effect of emotional valence upon color naming (...) (Experiment 2) indicated that words were identified at study. Thus, word-identification priming was reduced even when word identification occurred at study. Word-identification priming may depend on awareness of word identity at the time of study. (shrink)

Interactions with global markets offer development opportunities for Indigenous communities. They also place pressure on the natural resources that communities depend upon for their livelihood and, in many cases, their political and cultural autonomy. These markets often interact with family-based enterprises embedded within commons, with important implications for the social relationships and shared territorial resources that characterise such regimes. In this paper, we analyse the relationships that exist between commons, global markets, and small-scale family enterprises, using the case of mezcal (...) production—an alcoholic beverage made from agave—in an Indigenous community in Oaxaca, Mexico. Most mezcal production is organized at the family level; yet the raw materials and inputs necessary for making mezcal are held communally and regulated by locally-crafted institutions. Empirical data show that as family enterprises engage with an emergent global market for mezcal, the commons become essential for not only protecting territorial resources but also maintaining a degree of autonomy from powerful global markets and value chains. However, this requires substantial investment in monitoring and enforcement, and for community members to value sustainable commons management over short-term economic self-interest. To seek autonomy while participating in global markets, producer families also join together to develop cooperative strategies to access markets on better terms. (shrink)

Se obtendrá la siguiente conclusión: que la lista de las expresiones que habitualmente se consideran constantes lógicas no comparten rasgos relevantes desde el punto de vista del significado que justifiquen su tratamiento como un grupo homogéneo. El primer asunto tiene relevancia porque las cuestiones preliminares en teoría de la verdad constriñen el desarrollo posterior de la teoría de manera determinante; el segundo aspecto tiene relevancia porque la crítica de Puntel encierra ciertos malentendidos de fondo que desdibujan su propia posición y le impiden tener el alcance que el Prof. Puntel le atribuye. Combining the liberalism of Locke and the "civic humanism" of Republicanism, Mary Wollstonecraft explored the need of women for coed and equal education with men, economic independence whether married or not, and representation as citizens in the halls of government. In doing so, she foreshadowed and surpassed her much better known successor, John Stuart Mill. Ten feminist scholars prominent in the fields of political philosophy, constitutional and international law, rhetoric, literature, and psychology argue here that Wollstonecraft, by reason of the (...) scope and complexity of her thought, belongs in the "canon" of political philosophers along with Rousseau and Burke, her contemporaries, both of whom she strenuously engaged in political debate. These essays explore the many aspects of her thought that resound so tellingly to the modern woman, including her groundbreaking attempt to be completely self-sufficient. The final bibliographical essay outlines the changing interpretations of Wollstonecraft's work over the past two hundred years and evaluates her standing among political theorists today. Traditionally, in Spain bullfighting represents an ancient and well-respected tradition and a combined brand of sport, art and national identity. However, bullfighting has received considerable criticism from various segments of society, with the concomitant rise of the animal rights movement. The paper reports a survey of the Spanish citizens using a face-to-face survey during January 2016 with a total sample of 2522 citizens. The survey asked about degree of liking and approving; culture, art and national identity; socio-economic aspects; emotional perception (...) and animal welfare. The hypothesis proposed that the perception of bullfights may be affected by gender, age, occupation, origin and nationality of the persons surveyed. The hypothesis was confirmed. The majority of citizens surveyed do not like bullfights and great majorities do not attend or watch such events. Two extreme clusters were described: one representing favorable attitude towards bullfighting and other against bullfighting. The proportion of indifferent persons was important. Women and young people showed a more favorable attitude towards animal welfare issues associated with these events. Rural people were more accepting bullfights than urban people. Students were more anti-bullfight than those in other occupations. Additionally, technical economic factors made people favor more bullfights. The growth of claim against bullfights establishes an element of a far more multifaceted phenomenon that animal cruelty per se and support of a new paradigm called social change in countries as Spain. This study investigates priming in an implicit Word Stem Completion (WSC) task. A total of 305 participants performed a WSC task in two phases (study and test). The test phase included 63 unique-solution stems and 63 multiple-solution stems. After confirming the presence of priming (mean = 0.22), analysis revealed that it was stronger in the case of multiple-solution stems, indicating that the stems were not a homogeneous group of stimuli. Thus, further analyses were performed only for the data of the (...) unique-solution stems. The correlations between priming and a set of conceptual (familiarity, frequency of use, number of meanings) and non-conceptual (letters/blanks ratio and difficulty of completed) variables showed significant relationships between two conceptual variables (familiarity and frequency) and priming. Difficulty was also significantly correlated with priming. The most familiar and frequent words were those that produced a greater magnitude of priming. At the same time, the most difficult stems were those generating more priming. A regression analysis showed that the difficulty of completing a stem was the strongest predictor of priming. When difficulty was the dependent variable in the regression analysis, the significant variables in the regression were familiarity and letters-blanks ratio. Finally, a comparison was made between these results and those obtained in a previous study of WFC by Soler et al. (2009) in which the same words and procedure were employed. A comparison of results from these two sets of data suggested that the only relevant difference between the two tasks was the influence of the variable letters-blanks ratio. This perceptual variable had a significant correlation with priming only in the WFC task. These results highlight the importance of controlling the characteristics (conceptual and non-conceptual) of stimuli used in WFC and WSC tasks when exploring the nature of priming. (shrink)

Decision support systems, which incorporate artificial intelligence and big data, are receiving significant attention in the public sector. Decision support systems are sociocultural artefacts that are subject to a mix of technical and political choices, and critical investigation of these choices and the rationales they reflect are paramount since they are inscribed into and may cause harm, violate fundamental rights and reproduce negative social patterns. Applying and merging the concepts of sense-making and translation, this article investigates the rationales, translations and (...) critical reflections that shape the development of a decision support system to support social workers assessing referrals concerning child neglect. It presents findings from a qualitative case study conducted in 2019–2020 at the Citizen Centre Children and Young People, Copenhagen Municipality, Denmark. The analysis shows how key actors through processes of translation construct, negotiate and readjust problem definitions, roles, interests, responsibilities and ideas of ambiguity and accountability. Although technological solutionism is present in these processes, it is not the only rationale invested. Rather, technological and data-driven rationales are adjusted to and merged with rationales of efficiency, return on investment and child welfare. Through continuous renegotiation of roles, responsibilities and problems according to these rationales, the key actors attempt to orchestrate ways of managing the complexity facing child welfare services by projecting images of future potentials of the decision support system that are yet to be realised. Concerns about business ethics have led many business schools to integrate ethics into the curriculum, with mixed results (May, Luth, & Schwoerer 2014, Wang & Calvano 2015, Waples, Antes, Murphy, Connelly & Mumford 2009). This paper seeks to improve our understanding of business students’ ethics by looking into their identity, a cognitive lens by which students see themselves and interpret their environment (Triandis 1989) and that can be relatively malleable to priming and socializing processes (Vignoles, Schwartz, & Luyckx 2011, Ybarra (...) & Trafimow 1998). Results show that undergraduate students with higher individual and lower collective identities report lower intentions to behave ethically. Moreover, our results show that a business education has the power to influence students’ ethical intentions by altering their individual and collective identities. Our results suggest that business schools should consider the effects of their curriculum and pedagogies on the development of individual and collective identities to educate more ethical business students. This paper deals with a development of the ancient thought on mimesis in its modern reception as regards a certain idea of theatre. It defends the hypothesis that the figure of the character, as set up in Diderot’s Paradoxe sur le comédien, has its source in a curious reversal of the Platonic mimesis. After presenting the main tenets of Plato’s reflection on mimesis and of Diderot’s theory on character, showing their convergences and contrasts, it is analyzed how such a conceptual (...) turnaround has historically taken place, by establishing a chain of reception from Plato to Diderot passing through Cicero and the Renaissance artists. Durante más de 3000 años, las religiones patriarcales han simbolizado un sistema socio-político e ideológico, que dominó hasta hoy la historia universal. Sin embargo, desde hace por lo menos dos siglos, el pensamiento y la cultura vienen anunciando la muerte del Dios Padre e indagando el destino de la humanidad futura. El presente trabajo intentará mostrar por qué la Gran Diosa Madre simboliza el Otro Nombre, en el cual la subjetividad y la cultura han comenzado a pronunciarse.
